Chile: Bill to regulate the protection of nature and environmental human rights defenders


Bill in process in the Chamber of Deputies (date of entry May 29, 2024), which seeks to enshrine a regulatory framework of protection for human rights defenders in environmental and nature issues that makes the Escazú Agreement operative in Chile.

Article 1 includes the 4 objectives of the Law:
a) To guarantee a safe and enabling environment in which individuals, groups and organizations that promote and defend human rights in environmental matters can act without threats, restrictions and insecurities.

b) To recognize, respect, protect and promote the human rights and fundamental freedoms of persons who, individually or collectively, promote the enforcement of human rights in environmental matters and the protection of nature, both nationally and internationally.

c) Establish a regulatory framework that contains adequate and effective mechanisms for the protection of human rights defenders in environmental matters and the protection of nature, including preventive measures and a timely reaction to violations of their rights.

d) Affirm the commitment of the State of Chile to the implementation and compliance with declarations, treaties, conventions and other instruments, both domestic and international, related to human rights and the protection of the environment.
